DUI

Criminal Defense / DUI

A DUI charge, known as an OVI charge in the State of Ohio, is one of the most frequent criminal charges that attorney Scott Kelly sees in his practice. A DUI charge can happen to anyone, from a friend or family member to yourself. Most people who are facing DUI charges may never have had a more serious brush with the law before.

Many people who are charged with DUI do not understand how serious the offense is. For a first time offense, it is a first degree misdemeanor, punishable by a maximum of 6 months in jail and $1000 fines and court costs. It includes a mandatory license suspension and mandatory 3 days in jail or 3 day driver intervention program. Many people do not consider the economic impact of limited driving privileges and increased insurance costs associated with a DUI.

Aggressive DUI Defense

You likely know someone who has “pled out” to a DUI charge, sometimes even after having hired an attorney. Unfortunately, many DUI charges should be reduced or dismissed that are not. DUI practice is highly complicated, and constantly changing, and it requires knowledge of traffic laws, field sobriety testing procedures, breath alcohol testing rules, as well as drug testing rules. Many attorneys who do not focus on DUI practice do not know to aggressively defend a DUI charge. Before you hire an attorney, ask them these three questions: 1) How much of your practice is dedicated to DUI defense? 2) Are you certified in the NHTSA Standardized Field Sobriety Testing course (the same training as law enforcement for DUI detection)? 3) How much of your continuing education is dedicated to keeping up with the ever changing DUI laws and case decisions?

Attorney Scott Kelly dedicates the majority of his practice to DUI defense, is certified in the NHTSA Standardized Field Sobriety Testing course, and dedicates all of his continuing education time to DUI defense. Combined with his years of experience handling DUI cases in the courts located in Miami County (Troy), Shelby County (Sidney), Darke County (Greenville), Logan County (Bellefontaine), Auglaize County (Wapakoneta), and Allen County (Lima), as well as the surrounding area, Scott Kelly is the right choice to handle your DUI defense.
